(a) Notwithstanding section 431:10C-802, an authorized insurer that writes motor vehicle insurance in the State may exclude any and all coverage and the duty to defend or indemnify any claim afforded under a shared car owner's motor vehicle insurance policy during the car-sharing period, including:\n\n(1) Liability coverage for bodily injury and property damage;\n\n(2) Personal injury protection coverage as set forth in section 431:10C-304;\n\n(3) Uninsured and underinsured motorist coverage;\n\n(4) Medical payments coverage;\n\n(5) Comprehensive physical damage coverage; and\n\n(6) Collision physical damage coverage.\n\n( b) Except as required under section 431:10C-802, nothing in this part shall invalidate or limit an exclusion contained in a motor vehicle insurance policy, including any insurance policy in use or approved for use that excludes coverage for motor vehicles made available for rent, sharing, or hire.","path":["Hawaii Code","Division 2","Title 24","Chapter 431"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431/HRS_0431-0010C-0803.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"547ef88c3f86d380185db8f47cfaa5f15ef23d8f1bec54505a13a4a3d22400c5","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431-10c-802","next":"us-hi/haw.-rev.-stat.-431-10c-804"},"notice":"GroundRules: Original legal text.
