Stat. § 431:10H-109","heading":"Prior hospitalization; prior institutionalization.","body":"(a) No long-term care insurance policy may be delivered or issued for delivery in this State if the policy:\n\n(1) Conditions eligibility for any benefits on a prior hospitalization requirement;\n\n(2) Conditions eligibility for benefits provided in an institutional care setting on the receipt of a higher level of institutional care; or\n\n(3) Conditions eligibility for any benefits other than waiver of premium, post-confinement, post-acute care, or recuperative benefits on a prior institutionalization requirement.\n\n(b) A long-term care insurance policy containing post-confinement, post-acute care, or recuperative benefits shall clearly label, in a separate paragraph of the policy or certificate, entitled \"Limitations or Conditions on Eligibility for Benefits\", such limitations or conditions including any required number of days of confinement.\n\n(c) A long-term care insurance policy that conditions eligibility of non-institutional benefits on the prior receipt of institutional care shall not require a prior institutional stay of more than thirty days.","path":["Hawaii Code","Division 2","Title 24","Chapter 431"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431/HRS_0431-0010H-0109.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"ee5a1f054e87c36d25cf7346578ffc700c6cdb30c4567f629d8068de454976de","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431-10h-108","next":"us-hi/haw.-rev.-stat.-431-10h-110"},"notice":"GroundRules: Original legal text.
