Stat. § 431:4-108","heading":"Application for a solicitation permit.","body":"To apply for a solicitation permit a person shall:\n\n(1) File with the commissioner a request showing:\n\n(A) Name, type and purpose of insurer or corporation proposed to be formed;\n\n(B) Names, addresses and business records of each person associated or to be associated with in the formation of the proposed insurer or corporation;\n\n(C) Full disclosure of the terms of all understandings and agreements existing or proposed among persons so associated relative to the proposed insurer or corporation or the formation thereof;\n\n(D) The plan according to which solicitations are to be made;\n\n(E) Such additional information as the commissioner may reasonably require.\n\n(2) File with the commissioner:\n\n(A) (i) The articles of incorporation, or\n\n(ii) The proposed subscribers' agreement and power of attorney, if the proposed insurer is a reciprocal;\n\n(B) Original and one copy of any proposed bylaws;\n\n(C) Copy of any security proposed to be issued and copy of application or subscription agreement therefor;\n\n(D) Copy of any insurance contract proposed to be offered and copy of application therefor;\n\n(E) Copy of any prospectus, advertising or literature proposed to be used;\n\n(F) Copy of proposed form of any escrow agreement required.\n\n(3) Deposit with the commissioner the appropriate fees required by this code.","path":["Hawaii Code","Division 2","Title 24","Chapter 431"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431/HRS_0431-0004-0108.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"a14903ec2437baeaec13e0e3acf4d162df2e10f0229cee9fb1f45426b1d98a6e","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431-4-107","next":"us-hi/haw.-rev.-stat.-431-4-109"},"notice":"GroundRules: Original legal text.
