Stat. § 431:9-240","heading":"Fine in lieu.","body":"(a) Upon the hearing of an appeal from an order suspending, revoking, or refusing to extend any license issued under this article, the court may impose a fine of not more than $10,000 in lieu of the commissioner's action, and payment of the fine within ten days shall reinstate, restore or extend, the license if:\n\n(1) The court finds that the licensee is guilty of violation of the law; and\n\n(2) The court deems the suspension, revocation, or refusal too severe a penalty under the facts as found.\n\n(b) If it appears that a license of the licensee has previously been suspended, revoked, or refused for a similar offense, the court shall not have jurisdiction to impose a fine in lieu of the commissioner's action.","path":["Hawaii Code","Division 2","Title 24","Chapter 431"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431/HRS_0431-0009-0240.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"e1cb78e5ed94924c4b129e3adc343a2ac0c89c6bab0288090142592760c9c11a","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431-9-239","next":"us-hi/haw.-rev.-stat.-431-9-242"},"notice":"GroundRules: Original legal text.
