Stat. § 431C-46","heading":"Confidentiality.","body":"(a) The documents and evidence provided pursuant to section 431C-45 or obtained by the commissioner in an investigation of suspected or actual fraudulent life settlement acts shall be privileged and confidential and shall not be a public record and shall not be subject to discovery or subpoena in a civil or criminal action.\n\n(b) Subsection (a) does not prohibit release by the commissioner of documents and evidence obtained in an investigation of suspected or actual fraudulent life settlement acts:\n\n(1) In administrative or judicial proceedings to enforce laws administered by the commissioner;\n\n(2) To federal, state, or local law enforcement or regulatory agencies, to an organization established for the purpose of detecting and preventing fraudulent life settlement acts, or to the National Association of Insurance Commissioners; or\n\n(3) At the discretion of the commissioner, to a person in the business of life settlements that is aggrieved by a fraudulent life settlement act.\n\n(c) Release of documents and evidence under subsection (b) does not abrogate or modify the privilege granted in subsection (a).","path":["HI Code","Division 2","Title 24","Chapter 431C"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431C/HRS_0431C-0046.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"922b20df0c95c019c457aef95b8150c1bf7bf5ceb911f711d490d313dbe3032c","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431c-45","next":"us-hi/haw.-rev.-stat.-431c-47"},"notice":"GroundRules: Original legal text.
