Stat. § 431N-5","heading":"Rulemaking authority.","body":"The director of health shall adopt rules in accordance with chapter 91 which are necessary to carry out this chapter. The rules shall include, but need not be limited to:\n\n(1) Establishment of guidelines for the purchase of health care coverage from health care contractors by the department;\n\n(2) Establishment of specific health care services to be covered, limited, and excluded by the program, including preventive services, outreach, and education strategies designed to reach gap group individuals;\n\n(3) Establishment of eligibility requirements for participation in the program;\n\n(4) Development and implementation of an identification and notification process for eligible program participants;\n\n(5) Establishment of a payment schedule based on the person's ability to pay;\n\n(6) Establishment of program participation criteria for health care contractors;\n\n(7) Establishment of monitoring and evaluative guidelines for the program;\n\n(8) Establishment of appeal procedures for denial of eligibility, disqualification from program participation, assessment of civil penalties, or other negative action; and\n\n(9) Establishment of procedures to exclude or remove from the program persons who drop individual or group coverage to obtain insurance.","path":["HI Code","Division 2","Title 24","Chapter 431N"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol09_Ch0431-0435H/HRS0431N/HRS_0431N-0005.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"104c0a808d23737573118e2f1092da5802daa35789199a1b2c8d3e27dc71fbd1","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-431n-4","next":"us-hi/haw.-rev.-stat.-431n-6"},"notice":"GroundRules: Original legal text.
