Stat. § 457A-2","heading":"Implementation.","body":"(a) The director shall implement the provisions of this chapter, in accordance with 42 United States Code sections 1395i-3 and 1396r, that relate to:\n\n(1) The minimum requirements and standards for certification as a nurse aide;\n\n(2) Examination requirements, including the passing score;\n\n(3) Maintenance requirements for continued certification on a biennial basis; and\n\n(4) Implementation of a certified nurse aide registry.\n\n(b) The director of health shall implement this chapter in accordance with 42 United States Code sections 1395i-3 and 1396r, that relate to disciplining certified nurse aides who are employed in:\n\n(1) Nursing facilities participating in medicare and medicaid programs; and\n\n(2) Health care settings licensed or certified by the department of health.\n\n(c) The director of human services shall implement this chapter in accordance with 42 United States Code sections 1395i-3 and 1396r, that relate to training programs for nurse aides and recertification; provided that recertification shall be required not less than every two years and the number of continuing education hours required for recertification shall not exceed twenty-four hours, except as specified by federal law.","path":["HI Code","Division 2","Title 25","Chapter 457A"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol10_Ch0436-0474/HRS0457A/HRS_0457A-0002.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"244f63e3c28356dc3d821bc96fbb452baeb40f9066807e53387342a51248d38a","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-457a-1.5","next":"us-hi/haw.-rev.-stat.-457a-3"},"notice":"GroundRules: Original legal text.
