Stat. § 465D-5","heading":"Powers and duties of the director.","body":"In addition to any other powers and duties authorized by law, the director shall have the powers and duties to:\n\n(1) Grant, deny, renew, refuse to renew, restore, terminate, reinstate, condition, restrict, suspend, or revoke a license issued pursuant to this chapter;\n\n(2) Grant permission to a person to engage in the practice of applied behavior analysis and to use the title of \"licensed behavior analyst\" or a description indicating that the person is a licensed behavior analyst in this State;\n\n(3) Adopt, amend, or repeal rules pursuant to chapter 91 as the director finds necessary to carry out this chapter;\n\n(4) Administer, coordinate, and enforce this chapter;\n\n(5) Discipline a licensed behavior analyst on grounds specified by this chapter or chapter 436B or for any violation of rules adopted by the director pursuant to this chapter; and\n\n(6) Refuse to license a person for failure to meet the licensing requirements in this chapter or for any reason specified by this chapter as grounds to discipline a behavior analyst including but not limited to violations of the Behavior Analyst Certification Board's ethical guidelines for responsible conduct.","path":["HI Code","Division 2","Title 25","Chapter 465D"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol10_Ch0436-0474/HRS0465D/HRS_0465D-0005.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"5f93445f727067ae8261e17d24b3e9957f27a0c11082251cee8e96f5d2ae3ec6","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-465d-4","next":"us-hi/haw.-rev.-stat.-465d-6"},"notice":"GroundRules: Original legal text.
