Stat. § 490:9-309","heading":"Security interest perfected upon attachment.","body":"The following security interests are perfected when they attach:\n\n(1) A purchase-money security interest in consumer goods, except as otherwise provided in section 490:9-311(b) with respect to consumer goods that are subject to a statute or treaty described in section 490:9-311(a);\n\n(2) An assignment of accounts or payment intangibles which does not by itself or in conjunction with other assignments to the same assignee transfer a significant part of the assignor's outstanding accounts or payment intangibles;\n\n(3) A sale of a payment intangible;\n\n(4) A sale of a promissory note;\n\n(5) A security interest created by the assignment of a health-care-insurance receivable to the provider of the health-care goods or services;\n\n(6) A security interest arising under section 490:2-401, 490:2-505, 490:2-711(3), or 490:2A-508(e), until the debtor obtains possession of the collateral;\n\n(7) A security interest of a collecting bank arising under section 490:4-210;\n\n(8) A security interest of an issuer or nominated person arising under section 490:5-118;\n\n(9) A security interest arising in the delivery of a financial asset under section 490:9-206(c);\n\n(10) A security interest in investment property created by a broker or securities intermediary;\n\n(11) A security interest in a commodity contract or a commodity account created by a commodity intermediary;\n\n(12) An assignment for the benefit of all creditors of the transferor and subsequent transfers by the assignee thereunder;\n\n(13) A security interest created by an assignment of a beneficial interest in a decedent's estate; and\n\n(14) A sale by an individual of an account that is a right to payment of winnings in a lottery or other game of chance.","path":["Hawaii Code","Division 2","Title 27","Chapter 490"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol11_Ch0476-0490/HRS0490/HRS_0490-0009-0309.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"ba231784bd25e392cc0b3854fd8b3e271ef270e20f362fe79c01956cbf20bf9d","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-490-9-307","next":"us-hi/haw.-rev.-stat.-490-9-310"},"notice":"GroundRules: Original legal text.
