Stat. § 516D-12","heading":"Mandatory arbitration of rent renegotiation.","body":"(a) Every residential lease shall contain a provision for the mandatory arbitration of any rent renegotiation reopening.\n\n(b) In the event that a residential lease does not contain a mandatory arbitration provision, the following arbitration procedure shall apply:\n\n(1) Rent shall be determined by three impartial arbitrators, who shall be recognized real estate appraisers;\n\n(2) Each party shall select an arbitrator, both of whom shall select the third arbitrator;\n\n(3) The three arbitrators shall determine the rent renegotiation which shall be final, conclusive, and binding on both parties; and\n\n(4) Lessor and lessee shall each pay one-half of all proper costs and expenses other than attorneys' fees.","path":["HI Code","Division 3","Title 28","Chapter 516D"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol12_Ch0501-0588/HRS0516D/HRS_0516D-0012.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"c665a5a11dd61deac4b27f8fd6d6f415bc1ba17de44f97ca5535a5bbf78697d8","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-516d-11.6","next":"us-hi/haw.-rev.-stat.-516"},"notice":"GroundRules: Original legal text.
