Stat. § 553A-6","heading":"Other transfer by fiduciary.","body":"(a) Subject to subsection (c), a personal representative or trustee may make an irrevocable transfer to another adult or trust company as custodian for the benefit of a minor pursuant to section 553A-9, in the absence of a will or under a will or trust that does not contain an authorization to do so.\n\n(b) Subject to subsection (c), a conservator may make an irrevocable transfer to another adult or trust company as custodian for the benefit of the minor pursuant to section 553A-9.\n\n(c) A transfer under subsection (a) or (b) may be made only if:\n\n(1) The personal representative, trustee, or conservator considers the transfer to be in the best interest of the minor;\n\n(2) The transfer is not prohibited by or inconsistent with provisions of the applicable will, trust agreement, or other governing instrument; and\n\n(3) The transfer is authorized by the court if it exceeds $10,000 in value.","path":["HI Code","Division 3","Title 30","Chapter 553A"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol12_Ch0501-0588/HRS0553A/HRS_0553A-0006.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"62c927e740504c790d2655cd5e2aca2c2583a292c6a52e9442436f73df407e0d","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-553a-5","next":"us-hi/haw.-rev.-stat.-553a-7"},"notice":"GroundRules: Original legal text.
