Stat. § 571-46.5","heading":"Parenting plans.","body":"(a) For every action that includes a contested custody of children, both parties or both parents shall develop either a mutually agreed-upon general parenting plan or separate individually-desired parenting plan, and file the plan at the outset of the action.\n\n(b) A parenting plan may include a general outline relating to parental responsibilities and parenting time. A general parenting plan may also allow the parents to develop a more detailed agreement on an informal basis.\n\n(c) A detailed parenting plan may include, but is not limited to, provisions relating to:\n\n(1) Residential schedule;\n\n(2) Holiday, birthday, and vacation planning;\n\n(3) Parental decision-making and responsibility;\n\n(4) Breastfeeding, if applicable;\n\n(5) Information sharing and access;\n\n(6) Relocation of parents;\n\n(7) Telephone access and other means of communication;\n\n(8) Right of first refusal procedures;\n\n(9) Transportation; and\n\n(10) Methods for changing or enforcing the parenting plan and for resolving disputes.\n\n(d) If the parties cannot agree on a parenting plan, the court may:\n\n(1) Order the parties to participate in alternative dispute resolution and in counseling with a person with professional experience in child custody or parenting issues, or with other appropriate education, unless there is a finding of family violence; and\n\n(2) Develop and file a detailed parenting plan when requested by either of the parties or parents.\n\n(e) The court or the parties may revise and amend the parenting plan from time to time.","path":["HI Code","Division 3","Title 31","Chapter 571"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol12_Ch0501-0588/HRS0571/HRS_0571-0046_0005.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"aca1866a1c335194dcb7545372bd4f18bb842c3391881682e8415650e0b87dba","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-571-46.4","next":"us-hi/haw.-rev.-stat.-571-46.6"},"notice":"GroundRules: Original legal text.
