Stat. § 572D-3","heading":"Content.","body":"(a) Parties to a premarital agreement may contract with respect to:\n\n(1) The rights and obligations of each of the parties in any of the property of either or both of them whenever and wherever acquired or located;\n\n(2) The right to buy, sell, use, transfer, exchange, abandon, lease, consume, expend, assign, create a security interest in, mortgage, encumber, dispose of, or otherwise manage and control property;\n\n(3) The disposition of property upon separation, marital dissolution, death, or the occurrence or nonoccurrence of any other event;\n\n(4) The modification or elimination of spousal support;\n\n(5) The making of a will, trust, or other arrangement to carry out the provisions of the agreement;\n\n(6) The ownership rights in and disposition of the death benefit from a life insurance policy;\n\n(7) The choice of law governing the construction of the agreement; and\n\n(8) Any other matter, including their personal rights and obligations, not in violation of public policy or a statute imposing a criminal penalty.\n\n(b) The right of a child to support may not be adversely affected by a premarital agreement.","path":["HI Code","Division 3","Title 31","Chapter 572D"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol12_Ch0501-0588/HRS0572D/HRS_0572D-0003.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"9b69a630c962dd38ada4541899007cf73bcf9245e1a1d0a8c35c483e2c628999","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-572d-2","next":"us-hi/haw.-rev.-stat.-572d-4"},"notice":"GroundRules: Original legal text.
