Stat. § 576B-204","heading":"Simultaneous proceedings.","body":"(a) A tribunal of this State may exercise jurisdiction to establish a support order if the petition or comparable pleading is filed after a pleading is filed in another state or a foreign country only if:\n\n(1) The petition or comparable pleading in this State is filed before the expiration of the time allowed in the other state or the foreign country for filing a responsive pleading challenging the exercise of jurisdiction by the other state or the foreign country;\n\n(2) The contesting party timely challenges the exercise of jurisdiction in the other state or the foreign country; and\n\n(3) If relevant, this State is the home state of the child.\n\n(b) A tribunal of this State may not exercise jurisdiction to establish a support order if the petition or comparable pleading is filed before a petition or comparable pleading is filed in another state or a foreign country if:\n\n(1) The petition or comparable pleading in the other state or foreign country is filed before the expiration of the time allowed in this State for filing a responsive pleading challenging the exercise of jurisdiction by this State;\n\n(2) The contesting party timely challenges the exercise of jurisdiction in this State; and\n\n(3) If relevant, the other state or foreign country is the home state of the child.","path":["HI Code","Division 3","Title 31","Chapter 576B"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol12_Ch0501-0588/HRS0576B/HRS_0576B-0204.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"bebd13ff8d6c88ccdb210d20157ecaac24bd3c54788e0880860da9f98493bcbb","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-576b-203","next":"us-hi/haw.-rev.-stat.-576b-205"},"notice":"GroundRules: Original legal text.
