Stat. § 662D-3","heading":"Exception.","body":"Notwithstanding section 662D-2, if otherwise permitted by law, a person may sue and recover civil damages from a volunteer based upon:\n\n(1) Any conduct engaged in by the volunteer that would constitute gross negligence, wilful and wanton misconduct, or intentional misconduct;\n\n(2) Any act or omission in connection with the operation of a motor vehicle;\n\n(3) Any conduct engaged in by the volunteer while the volunteer is unreasonably interfering with the lawful activities of another;\n\n(4) Any conduct engaged in by the volunteer that takes place on private property when the volunteer's presence on the property was not consented to by the owner;\n\n(5) Any act or omission within a volunteer's scope of practice for which the volunteer is licensed, certified, permitted, or registered under state law to perform; provided that this paragraph shall not apply to volunteer medical assistance services pursuant to section 321-2.5; and\n\n(6) Any criminal offense committed by the volunteer.","path":["HI Code","Division 4","Title 36","Chapter 662D"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol13_Ch0601-0676/HRS0662D/HRS_0662D-0003.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"19fff3ee448f4aafc113974d5c8ac86bcacee02d7c39b4b8c9ea28fb7989264f","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-662d-2","next":"us-hi/haw.-rev.-stat.-662d-4"},"notice":"GroundRules: Original legal text.
