Stat. § 708-892.5","heading":"Computer damage in the second degree.","body":"(1) A person commits the offense of computer damage in the second degree if:\n\n(a) The person knowingly causes the transmission of a program, information, code, or command, and thereby knowingly causes unauthorized damage to a computer, computer system, or computer network; or\n\n(b) The person intentionally accesses a computer, computer system, or computer network without authorization and thereby knowingly causes damage.\n\n(2) As used in this section, \"damage\" means:\n\n(a) A loss aggregating at least $5,000 in value, including the costs associated with diagnosis, repair, replacement, or remediation, during any one-year period to one or more individuals;\n\n(b) The modification or impairment, or potential modification or impairment, of the medical examination, diagnosis, treatment, or care of one or more individuals; or\n\n(c) Impairment or disruption of government operations.\n\n(3) Computer damage in the second degree is a class B felony.","path":["HI Code","Division 5","Title 37","Chapter 708"],"source_url":"http://www.capitol.hawaii.gov/hrscurrent/Vol14_Ch0701-0853/HRS0708/HRS_0708-0892_0005.htm","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:11Z","sha256":"3fdd81bb3c5609a6051b6b6b286b239cbd0f8caf5c10303516736dca83d1a48f","source_id":"us-hi","stale":false,"prev":"us-hi/haw.-rev.-stat.-708-892","next":"us-hi/haw.-rev.-stat.-708-892.6"},"notice":"GroundRules: Original legal text.
