Except as provided in subsection 3 and sections 459.203, 459.205, and 459.206, this subsection applies to confinement feeding operation structures constructed on or after May 31, 1995, but prior to January 1, 1999; and to the expansion of structures constructed prior to January 1, 1999.\nb. The following table represents the minimum separation distance in feet required between a confinement feeding operation structure and a residence not owned by the owner of the confinement feeding operation, or a commercial enterprise, a bona fide religious institution, or an educational institution:\n\tMinimum separation\n\tdistance in feet for\n\toperations having\n\tMinimum separation\tan animal weight\tMinimum separation\n\tdistance in feet for\tcapacity of 625,000\tdistance in feet for\n\toperations having\tor more pounds but\toperations having\n\tan animal weight\tless than 1,250,000\tan animal weight\n\tcapacity of less than\tpounds for animals\tcapacity of 1,250,000\n\t625,000 pounds for\tother than cattle,\tor more pounds for\n\tanimals other than\tor 1,600,000 or more\tanimals other than\n\tcattle, or less than\tpounds but less than\tcattle, or 4,000,000\n\t1,600,000 pounds for \t4,000,000 pounds for \tor more pounds for\nType of structure\tcattle\tcattle\tcattle\nAnaerobic lagoon\t1,250\t1,875\t2,500\nUncovered earthen\n manure storage basin\t1,250\t1,875\t2,500\nUncovered formed\n manure storage\n structure\t1,000\t1,500\t2,000\nCovered earthen\n manure storage basin\t 750\t1,000\t1,500\nCovered formed\n manure storage\n structure\t 750\t1,000\t1,500\nConfinement building\t 750\t1,000\t1,500\nEgg washwater\n storage structure\t 750\t1,000\t1,500\n2. a.
