A notarial officer may refuse to perform a notarial act if the notarial officer is not satisfied that any of the following apply:\na. The individual executing the record is competent or has the capacity to execute the record.\nb. The individual’s signature is knowingly and voluntarily made.\n2. A notarial officer may refuse to perform a notarial act unless refusal is prohibited by law other than this chapter.\n3. A notarial officer shall not condition the performing of notarial services upon the requirement that the person served be a customer or client of the establishment by which the notarial officer is employed.
