{"data":{"id":"us-id/idaho-code-14-5-1205","jurisdiction":"us-id","citation":"Idaho Code § 14-5-1205","heading":"OTHER CIVIL PENALTIES.","body":"(1) If a holder enters into a contract or other arrangement for the purpose of evading an obligation under this chapter or otherwise willfully fails to perform a duty imposed on the holder under this chapter, the administrator may require the holder to pay the administrator, in addition to interest as provided in section 14-5-1204(1), Idaho Code, a civil penalty of one thousand dollars ($1,000) for each day the obligation is evaded or the duty is not performed, up to a cumulative maximum amount of twenty-five thousand dollars ($25,000), plus twenty-five percent (25%) of the amount or value of property that should have been but was not reported, paid, or delivered as a result of the evasion or failure to perform.\n(2) If a holder makes a fraudulent report under this chapter, the administrator may require the holder to pay to the administrator, in addition to interest under section 14-5-1204(1), Idaho Code, a civil penalty of one thousand dollars ($1,000) for each day from the date the report was made until corrected, up to a cumulative maximum of twenty-five thousand dollars ($25,000), plus twenty-five percent (25%) of the amount or value of any property that should have been reported but was not included in the report or was underreported.","path":["TITLE 14 ESTATES OF DECEDENTS","CHAPTER 5 REVISED UNCLAIMED PROPERTY ACT","PART 12 ENFORCEMENT BY ADMINISTRATOR"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title14/t14ch5/sect14-5-1205/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T13:31:34Z","sha256":"fd878d114bcb87544bd7afd4981017f9238a497ecbf4732add29e583f439ff25","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-14-5-1204","next":"us-id/idaho-code-14-5-1206"},"notice":"GroundRules: Original legal text.
