{"data":{"id":"us-id/idaho-code-19-3508","jurisdiction":"us-id","citation":"Idaho Code § 19-3508","heading":"eligibility for diversion program.","body":"A person is eligible to participate in a diversion program if:\n(1) The person has been charged with driving under the influence pursuant to section 18-8004 or 18-8004A, Idaho Code;\n(2) At the time of the conduct underlying such charge, the person:\n(a) Did not hold a commercial driver’s license or commercial learner’s permit; or\n(b) Was not operating a commercial vehicle;\n(3) No other person is alleged to have been physically injured as a result of the conduct underlying such charge; and\n(4) The person charged has not been convicted of driving under the influence or a substantially conforming foreign criminal violation within the past ten (10) years and has not previously participated in a diversion program pursuant to section 19-3509, Idaho Code.","path":["TITLE 19 CRIMINAL PROCEDURE","CHAPTER 35 DISMISSAL OF ACTION"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title19/t19ch35/sect19-3508/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T12:28:34Z","sha256":"602f4045459f2d262089fa1fa04b13ac7f9ee0446dcd47f547cc58d1689c17b5","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-19-3507","next":"us-id/idaho-code-19-3509"},"notice":"GroundRules: Original legal text.
