{"data":{"id":"us-id/idaho-code-32-923","jurisdiction":"us-id","citation":"Idaho Code § 32-923","heading":"Content.","body":"(1) Parties to a premarital agreement may contract with respect to:\n(a) The rights and obligations of each of the parties in any of the property of either or both of them whenever and wherever acquired or located;\n(b) The right to buy, sell, use, transfer, exchange, abandon, lease, consume, expend, assign, create a security interest in, mortgage, encumber, dispose of, or otherwise manage and control property;\n(c) The disposition of property upon separation, marital dissolution, death, or the occurrence or nonoccurrence of any other event;\n(d) The modification or elimination of spousal support;\n(e) The making of a will, trust, or other arrangement to carry out the provisions of the agreement;\n(f) The ownership rights in and disposition of the death benefit from a life insurance policy;\n(g) The choice of law governing the construction of the agreement; and\n(h) Any other matter, including their personal rights and obligations, not in violation of public policy or a statute imposing a criminal penalty.\n(2) The right of a child to support may not be adversely affected by a premarital agreement.","path":["TITLE 32 DOMESTIC RELATIONS","CHAPTER 9 HUSBAND AND WIFE — SEPARATE AND COMMUNITY PROPERTY"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title32/t32ch9/sect32-923/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:19:10Z","sha256":"9f9ebd9142e25395f96657a96d1b83da2a33faf2f94e3000a1fa1484d89eca96","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-32-922","next":"us-id/idaho-code-32-924"},"notice":"GroundRules: Original legal text.
