{"data":{"id":"us-id/idaho-code-33-5406","jurisdiction":"us-id","citation":"Idaho Code § 33-5406","heading":"Scholarships and financial aid provisions.","body":"(1) Any student loan program, student grant program or other financial assistance program established or administered by this state shall treat the balance in an account of which the student is a designated beneficiary as if it were an asset of the parent of the designated beneficiary and not as a scholarship or grant or as an asset of the student for determining a student’s or parent’s income, assets or financial need.\n(2) Subsection (1) of this section applies to any financial assistance program administered by a state-supported college or university.\n(3) Subsections (1) and (2) of this section do not apply if any of the following conditions exist:\n(a) Federal law requires all or a portion of the amount in an account to be taken into account in a different manner;\n(b) Federal benefits could be lost if all or a portion of the amount in an account is not taken into account in a different manner;\n(c) A specific grant establishing a financial assistance program requires that all or a portion of the amount in an account be taken into account.","path":["TITLE 33 EDUCATION","CHAPTER 54 COLLEGE SAVINGS PROGRAM"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title33/t33ch54/sect33-5406/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:19:31Z","sha256":"70388bb1f912ab061dd3ee973a0c543a88e3a92ae2128046c106e8672eaa74d9","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-33-5405","next":"us-id/idaho-code-33-5407"},"notice":"GroundRules: Original legal text.
