{"data":{"id":"us-id/idaho-code-33-6808","jurisdiction":"us-id","citation":"Idaho Code § 33-6808","heading":"remedies.","body":"(1) Subject to all provisions and limitations contained in the Idaho tort claims act, chapter 9, title 6, Idaho Code, any student or student organization may bring an action against a public institution of higher education and any of its employees, acting in their official capacities, for a violation of the student’s or student organization’s rights under this chapter.\n(2) If a court in an action under this section finds that a public institution of higher education has violated the rights of a student or student organization under this chapter, the court may award:\n(a) Injunctive relief;\n(b) Compensatory damages not to exceed twenty-five thousand dollars ($25,000);\n(c) Nominal damages;\n(d) Reasonable court costs; and\n(e) Attorney’s fees.","path":["TITLE 33 EDUCATION","CHAPTER 68 PROTECTING CAMPUS FREE SPEECH IN HIGHER EDUCATION ACT"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title33/t33ch68/sect33-6808/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T13:59:59Z","sha256":"9ebf886fbe2daf8f5d154f95dc43a572407512865dcbda41c2ade4b507b3320f","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-33-6807","next":"us-id/idaho-code-33-6809"},"notice":"GroundRules: Original legal text.
