{"data":{"id":"us-id/idaho-code-37-2727","jurisdiction":"us-id","citation":"Idaho Code § 37-2727","heading":"Controlled substances in opioid (narcotic) treatment programs.","body":"(1) At a facility with a controlled substance registration certificate issued by the United States department of justice, drug enforcement administration, for the operation of a narcotic treatment program, a nurse licensed under chapter 14, title 54, Idaho Code, may, pursuant to a valid order of a physician licensed under chapter 18, title 54, Idaho Code:\n(a) Prepare and administer to a patient at that facility a controlled substance whether or not a practitioner is present; and\n(b) Deliver at that facility to a patient for subsequent use by the patient off-site, take-home doses of a controlled substance, provided that:\n(i) The patient is entitled to receive take-home doses of the controlled substance;\n(ii) The take-home doses delivered by the nurse to the patient were obtained at the facility by the nurse from a locked storage area suitable to prevent unauthorized access and to ensure a proper environment for preservation of the drugs within such area; and\n(iii) The take-home doses were prepared pursuant to a valid prescription drug order of the physician and were provided in a suitable container appropriately labeled for use by the patient.\n(2) A nurse acting under the authority of this section is exempt from the registration requirements imposed by this chapter.\n(3) The facility must be registered under chapter 17, title 54, Idaho Code.","path":["TITLE 37 FOOD, DRUGS, AND OIL","CHAPTER 27 UNIFORM CONTROLLED SUBSTANCES","ARTICLE III"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title37/t37ch27/sect37-2727/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:19:47Z","sha256":"5115b6c69ccb1ef14e38760d5906d8742ba9c7a3e9d4dad39d6882373b40a27d","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-37-2726","next":"us-id/idaho-code-37-2730a"},"notice":"GroundRules: Original legal text.
