{"data":{"id":"us-id/idaho-code-39-7002","jurisdiction":"us-id","citation":"Idaho Code § 39-7002","heading":"Disposal of lead acid batteries.","body":"(1) The disposal of lead acid batteries in landfills and the incineration of those batteries is prohibited. An owner or operator of a solid waste disposal facility shall not knowingly accept a lead acid battery for disposal unless the owner or operator is removing lead acid batteries from the waste stream for recycling. A lead acid battery shall be discarded or disposed of only as follows:\n(a) A lead acid battery retailer or wholesaler may deliver a lead acid battery to any one (1) of the following:\n(i) A permitted secondary lead smelter.\n(ii) A battery manufacturer.\n(iii) A collection or recycling facility authorized by the federal environmental protection agency or department of environmental quality.\n(iv) In the case of battery retailers only, an agent of a battery wholesaler.\n(v) A landfill operator who offers collection services for recycling lead acid batteries.\n(2) A person other than a lead acid battery retailer or wholesaler may deliver a lead acid battery to any of the following:\n(a) A lead acid battery retailer or wholesaler.\n(b) A permitted secondary lead smelter.\n(c) A collection or recycling facility authorized by the federal environmental protection agency or the department of environmental quality.\n(d) A landfill operator who offers collection services for recycling lead acid batteries.","path":["TITLE 39 HEALTH AND SAFETY","CHAPTER 70 SALE AND DISPOSAL OF BATTERIES"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title39/t39ch70/sect39-7002/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:20:10Z","sha256":"41cf3ab2281ff6df650aa2da33ca5879227f8664a3fb17395997abdcb14416b8","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-39-7001","next":"us-id/idaho-code-39-7003"},"notice":"GroundRules: Original legal text.
