{"data":{"id":"us-id/idaho-code-41-1038","jurisdiction":"us-id","citation":"Idaho Code § 41-1038","heading":"Definitions.","body":"As used in sections 41-1037 through 41-1045, Idaho Code:\n(1) \"Bail\" means a monetary amount required by the court to release the defendant from custody and to ensure his appearance in court as ordered.\n(2) \"Bail agent\" means a person who is a licensed producer in the line of surety insurance that is authorized by an insurer to execute or countersign undertakings of bail in connection with judicial proceedings.\n(3) \"Bail bond\" means a financial guarantee, posted by a bail agent and underwritten by a surety insurance company, that the defendant will appear as ordered.\n(4) \"Collateral\" means property of any kind given as security to obtain a bail bond.\n(5) \"Department\" means the department of insurance.\n(6) \"Director\" means the director of the department of insurance.\n(7) \"Person\" means an individual or a business entity.\n(8) \"Retail consumers of bail bonds\" means a defendant and any person who provides collateral to obtain any portion of a bail bond.\n(9) \"Surety\" or \"surety insurance company\" means an admitted insurer authorized in the line of surety pursuant to title 41, Idaho Code.","path":["TITLE 41 INSURANCE","CHAPTER 10 PRODUCER LICENSING"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title41/t41ch10/sect41-1038/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:20:30Z","sha256":"b05958c35f02ff85446c8e8d8da298e6c8d8c6932a07987b8e7e4afc6131ae9b","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-41-1037","next":"us-id/idaho-code-41-1039"},"notice":"GroundRules: Original legal text.
