{"data":{"id":"us-id/idaho-code-48-509","jurisdiction":"us-id","citation":"Idaho Code § 48-509","heading":"Cancellation.","body":"The secretary of state shall cancel from the register, in whole or in part:\n(1) Any registration concerning which the secretary of state receives a voluntary request for cancellation from the registrant or the assignee of record;\n(2) All registrations granted under this act and not renewed in accordance with the provisions of this chapter;\n(3) Any registration concerning which a court of competent jurisdiction shall find that:\n(a) The registered mark has been abandoned;\n(b) The registrant is not the owner of the mark;\n(c) The registration was granted improperly;\n(d) The registration was obtained fraudulently;\n(e) The mark is or has become the generic name for the goods or services, or a portion thereof, for which it was registered;\n(f) The registered mark is so similar, as to be likely to cause confusion or mistake or to deceive, to a mark registered by another person in this state prior to the date of the filing of the application for registration by the registrant hereunder, and not abandoned; or\n(4) When a court of competent jurisdiction orders cancellation of a registration on any ground.","path":["TITLE 48 MONOPOLIES AND TRADE PRACTICES","CHAPTER 5 REGISTRATION AND PROTECTION OF TRADEMARKS"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title48/t48ch5/sect48-509/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:22:16Z","sha256":"513f89fc1b624637be079cf1242b179e1c89fbbddfaeaef9cfe6b2217dcf56ab","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-48-508","next":"us-id/idaho-code-48-510"},"notice":"GroundRules: Original legal text.
