{"data":{"id":"us-id/idaho-code-55-3204b","jurisdiction":"us-id","citation":"Idaho Code § 55-3204B","heading":"RESTRICTIONS ON BOARD MEMBERSHIP — PROXY VOTES.","body":"(1) Except during the period of declarant control of the homeowner’s association pursuant to section 55-3204A, Idaho Code, only one (1) owner per lot shall serve concurrently on the board of a homeowner’s association.\n(2) Votes allocated to the owners may be cast under a written proxy duly executed by the owner, pursuant to the provisions of the Idaho nonprofit corporation act under part 5, chapter 30, title 30, Idaho Code, except:\n(a) No single owner may hold proxies representing more than fifty percent (50%) of the total votes in the homeowner’s association; and\n(b) A person may not serve on the board of a homeowner’s association if the person is a member of the same household in the same primary residence as another board member of the homeowner’s association.\n(3) The provisions of subsection (2) of this section shall not apply to a homeowner’s association with fewer than twenty (20) residences or during the declarant control period of the homeowner’s association.","path":["TITLE 55 PROPERTY IN GENERAL","CHAPTER 32 HOMEOWNER’S ASSOCIATION ACT"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title55/t55ch32/sect55-3204b/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T13:52:44Z","sha256":"33dfa597e9865d584899eaffae56e35c84893e01a77df802299768183105bd6c","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-55-3204a","next":"us-id/idaho-code-55-3205"},"notice":"GroundRules: Original legal text.
