{"data":{"id":"us-id/idaho-code-7-1008","jurisdiction":"us-id","citation":"Idaho Code § 7-1008","heading":"Simultaneous proceedings.","body":"(1) A tribunal of this state may exercise jurisdiction to establish a support order if the petition or comparable pleading is filed after a pleading is filed in another state or a foreign country only if:\n(a) The petition or comparable pleading in this state is filed before the expiration of the time allowed in the other state or the foreign country for filing a responsive pleading challenging the exercise of jurisdiction by the other state or the foreign country;\n(b) The contesting party timely challenges the exercise of jurisdiction in the other state or the foreign country; and\n(c) If relevant, this state is the home state of the child.\n(2) A tribunal of this state may not exercise jurisdiction to establish a support order if the petition or comparable pleading is filed before a petition or comparable pleading is filed in another state or a foreign country if:\n(a) The petition or comparable pleading in the other state or foreign country is filed before the expiration of the time allowed in this state for filing a responsive pleading challenging the exercise of jurisdiction by this state;\n(b) The contesting party timely challenges the exercise of jurisdiction in this state; and\n(c) If relevant, the other state or foreign country is the home state of the child.","path":["TITLE 7 SPECIAL PROCEEDINGS","CHAPTER 10 UNIFORM INTERSTATE FAMILY SUPPORT ACT"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title7/t7ch10/sect7-1008/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:16:26Z","sha256":"260731d4a1761fcb3386c9574245cf62a026569223836e0e463f28944d9f5e40","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-7-1007","next":"us-id/idaho-code-7-1009"},"notice":"GroundRules: Original legal text.
