{"data":{"id":"us-id/idaho-code-7-1035","jurisdiction":"us-id","citation":"Idaho Code § 7-1035","heading":"establishment of support order.","body":"(1) If a support order entitled to recognition under this chapter has not been issued, a responding tribunal of this state with personal jurisdiction over the parties may issue a support order if:\n(a) The individual seeking the order resides outside this state; or\n(b) The support enforcement agency seeking the order is located outside this state.\n(2) The tribunal may issue a temporary child-support order if the tribunal determines that such an order is appropriate and the individual ordered to pay is:\n(a) A presumed father of the child;\n(b) Petitioning to have his paternity adjudicated;\n(c) Identified as the father of the child through genetic testing;\n(d) An alleged father who has declined to submit to genetic testing;\n(e) Shown by clear and convincing evidence to be the father of the child;\n(f) An acknowledged father as provided by section 7-1106, Idaho Code;\n(g) The mother of the child; or\n(h) An individual who has been ordered to pay child support in a previous proceeding and the order has not been reversed or vacated.\n(3) Upon finding, after notice and opportunity to be heard, that an obligor owes a duty of support, the tribunal shall issue a support order directed to the obligor and may issue other orders pursuant to section 7-1020, Idaho Code.","path":["TITLE 7 SPECIAL PROCEEDINGS","CHAPTER 10 UNIFORM INTERSTATE FAMILY SUPPORT ACT"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title7/t7ch10/sect7-1035/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:16:27Z","sha256":"130fc801f335a3e010d180c67168abdb74bb8c986cd371cdd62cd8e61e8a3998","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-7-1034","next":"us-id/idaho-code-7-1035a"},"notice":"GroundRules: Original legal text.
