{"data":{"id":"us-id/idaho-code-7-1062","jurisdiction":"us-id","citation":"Idaho Code § 7-1062","heading":"INITIATION BY department of health and welfare OF SUPPORT PROCEEDING UNDER CONVENTION.","body":"(1) In a support proceeding under sections 7-1059 through 7-1071, Idaho Code, the department of health and welfare shall:\n(a) Transmit and receive applications; and\n(b) Initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this state.\n(2) The following support proceedings are available to an obligee under the convention:\n(a) Recognition or recognition and enforcement of a foreign support order;\n(b) Enforcement of a support order issued or recognized in this state;\n(c) Establishment of a support order if there is no existing order, including, if necessary, determination of parentage of a child;\n(d) Establishment of a support order if recognition of a foreign support order is refused under section 7-1066(2)(b), (d) or (i), Idaho Code;\n(e) Modification of a support order of a tribunal of this state; and\n(f) Modification of a support order of a tribunal of another state or a foreign country.\n(3) The following support proceedings are available under the convention to an obligor against which there is an existing support order:\n(a) Recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state;\n(b) Modification of a support order of a tribunal of this state; and\n(c) Modification of a support order of a tribunal of another state or a foreign country.\n(4) A tribunal of this state may not require security, bond or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the convention.","path":["TITLE 7 SPECIAL PROCEEDINGS","CHAPTER 10 UNIFORM INTERSTATE FAMILY SUPPORT ACT"],"source_url":"https://legislature.idaho.gov/statutesrules/idstat/title7/t7ch10/sect7-1062/","current_through":"2026 Legislative Session","vintage":"","retrieved_at":"2026-09-04T11:16:27Z","sha256":"7103f9c91577d0a94551071d6e16105e01de69778538c02f822040998d410817","source_id":"us-id","stale":false,"prev":"us-id/idaho-code-7-1061","next":"us-id/idaho-code-7-1063"},"notice":"GroundRules: Original legal text.
