{"data":{"id":"us-il/10-ilcs-5-7-9.1","jurisdiction":"us-il","citation":"10 ILCS 5/7-9.1","heading":"","body":"(a) Except as otherwise provided in this Act, whenever a vacancy exists in the office of delegate to a State or national nominating convention by reason of death or for any other reason, then the alternate receiving the highest vote shall succeed to the vacated office and exercise all the rights and prerogatives and discharge all the duties of the office. The vacated office of alternate shall be filled by the congressional committee of the district.\n(b) Vacancies, whether temporary or permanent, in the office of delegate to the national nominating convention of a political party whose State Central Committee uses Alternative B of Section 7-14.1 shall be filled by alternate delegates in the following order:\n1. Alternates from the same District with same Presidential preference;\n2. Alternates from other Districts with same Presidential preference;\n3. Alternate at-large delegates with same Presidential preference;\n4. Alternates from the same District with different Presidential preference;\n5. Alternates from other Districts with different Presidential preference;\n6. Alternate at-large delegates with different Presidential preference.\nUnpledged delegates shall be replaced by unpledged alternates.\nEach delegate shall certify in writing the order of his succession of alternates to the chair of the State's delegation.\nThe delegation shall, as soon as practicable, fill a vacancy in the position of alternate delegate by choosing, in accord with its rules, a person of the same Presidential preference and from the same political subdivision.\nThe alternate succeeding to the vacated office shall exercise all the rights and prerogatives of the office and discharge all the duties of the office.","path":["CHAPTER 10 ELECTIONS","Election Code."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=170\u0026ChapterID=3\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:12Z","sha256":"7d1fc7560a249864f6413745f78328a1d060647bc355c83f3335e295d6d3c529","source_id":"us-il","stale":false,"prev":"us-il/10-ilcs-5-7-9","next":"us-il/10-ilcs-5-7-10"},"notice":"GroundRules: Original legal text.
