Refusal to appear or testify.","body":"(a) Any person not subject to this Code who:\n(1) has been duly subpoenaed to appear as a witness or to produce books and records before a court-martial or court of inquiry, or before any military or civil officer designated to take a deposition to be read in evidence before such a court;\n(2) has been duly paid or tendered the fees and mileage of a witness at the rates allowed to witnesses attending a criminal court of this State; and\n(3) willfully neglects or refuses to appear, or refuses to qualify as a witness or to testify or to produce any evidence which that person may have been legally subpoenaed to produce;\nmay be punished by the military court in the same manner as a criminal court of this State.\n(b) The fees and mileage of witnesses shall be advanced or paid out of the appropriations for the compensation of witnesses.","path":["CHAPTER 20 EXECUTIVE BRANCH","Illinois Code of Military Justice."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=3730\u0026ChapterID=5\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:14Z","sha256":"ecd8dee4db107f98b5d87a4747a3c76773b94ba4143bf7667dfffc99e422a1d1","source_id":"us-il","stale":false,"prev":"us-il/20-ilcs-1807-46","next":"us-il/20-ilcs-1807-48"},"notice":"GroundRules: Original legal text.
