In making its recommendation that an applicant's application for credit should or should not be accepted, which shall occur within a reasonable time frame as determined by the nature of the application, the Department shall determine that all the following conditions exist:\n(1) the applicant intends to make the required investment in the State and intends to hire the required number of full-time employees;\n(2) the applicant's project is economically sound, will benefit the people of the State by increasing opportunities for employment, and will strengthen the economy of the State;\n(3) awarding the credit will result in an overall positive fiscal impact to the State, as certified by the Department using the best available data; and\n(4) the credit is not prohibited under this Act.","path":["CHAPTER 20 EXECUTIVE BRANCH","Reimagining Energy and Vehicles in Illinois Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4229\u0026ChapterID=5\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:13Z","sha256":"1da59a6623a1abdb03c845edbd66ef85b5114e895a6b0558626f7ec9762759c0","source_id":"us-il","stale":false,"prev":"us-il/20-ilcs-686-20","next":"us-il/20-ilcs-686-30"},"notice":"GroundRules: Original legal text.
