{"data":{"id":"us-il/20-ilcs-861-35","jurisdiction":"us-il","citation":"20 ILCS 861/35","heading":"Provisions of the public-private agreement.","body":"(a) The public-private agreement may include, but is not limited to, the following:\n(1) the powers, duties, responsibilities, obligations, and functions of the Department and the contractor;\n(2) compensation or payments to the Department, if applicable;\n(3) compensation or payments to the contractor, if applicable;\n(4) a provision specifying that the Department:\n(A) has ready access to information regarding the contractor's powers, duties, responsibilities, obligations, and functions under the public-private agreement;\n(B) has the right to demand and receive information from the contractor concerning any aspect of the contractor's powers, duties, responsibilities, obligations, and functions under the public-private agreement; and\n(C) has the authority to direct or countermand decisions by the contractor at any time.\n(5) the authority of the contractor to impose user fees and the amounts of those fees;\n(6) a provision governing the deposit and allocation of revenues, including user fees;\n(7) a provision governing rights to real and personal property of the State, the Department, the contractor, and other third parties;\n(8) rights and remedies of the Department if the contractor defaults or otherwise fails to comply with the terms of the agreement; and\n(9) all other terms, conditions, and provisions acceptable to the Department that the Department deems necessary and proper and in the public interest.","path":["CHAPTER 20 EXECUTIVE BRANCH","Department of Natural Resources World Shooting and Recreational Complex Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4445\u0026ChapterID=5\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:14Z","sha256":"e967d6a29c46eb3996d0d63a9a51649e8fd9c6fcb0926f9511410e8bdc428244","source_id":"us-il","stale":false,"prev":"us-il/20-ilcs-861-30","next":"us-il/20-ilcs-861-40"},"notice":"GroundRules: Original legal text.
