{"data":{"id":"us-il/205-ilcs-405-29.5","jurisdiction":"us-il","citation":"205 ILCS 405/29.5","heading":"Cease and desist.","body":"The Secretary may issue a cease and desist order to any currency exchange or other person doing business without the required license, when in the opinion of the Secretary, the currency exchange or other person is violating or is about to violate any provision of this Act or any rule or requirement imposed in writing by the Department. The cease and desist order shall specify the activity or activities that the Department is seeking the currency exchange or other person doing business without the required license to cease and desist.\nThe cease and desist order permitted by this Section may be issued prior to a hearing.\nThe Secretary shall serve notice of his or her action, including, but not limited to, a statement of reasons for the action, either personally or by certified mail, return receipt requested. Service by certified mail shall be deemed completed (i) when the notice is deposited in the U.S. mail, received, or delivery is refused, or (ii) one business day after the United States Postal Service has attempted delivery, whichever is earlier.\nWithin 10 days after service of a cease and desist order, the licensee or other person may request, in writing, a hearing. The Secretary shall schedule a hearing within 30 days after the request for a hearing unless otherwise agreed to by the parties.\nIf it is determined that the Secretary has the authority to issue the cease and desist order, he or she may issue such orders as reasonably necessary to correct, eliminate, or remedy such conduct.\nThe powers vested in the Secretary by this Section are additional to any and all other powers and remedies vested in the Secretary by law, and nothing in this Section shall be construed as requiring that the Secretary shall employ the power conferred in this Section instead of or as a condition precedent to the exercise of any other power or remedy vested in the Secretary.\nThe currency exchange, or other person doing business without the required license, shall pay the actual costs of the hearing.","path":["CHAPTER 205 FINANCIAL REGULATION","Currency Exchange Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=1186\u0026ChapterID=20\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:29Z","sha256":"fb8efd3d3f860351cb1e1cee168e7e73528edf43f1cae921ed32679eca5c75bf","source_id":"us-il","stale":false,"prev":"us-il/205-ilcs-405-29","next":"us-il/205-ilcs-405-30"},"notice":"GroundRules: Original legal text.
