{"data":{"id":"us-il/225-ilcs-407-20-16","jurisdiction":"us-il","citation":"225 ILCS 407/20-16","heading":"Illegal discrimination.","body":"(Section scheduled to be repealed on January 1, 2030)\n(a) When there has been an adjudication in a civil or criminal proceeding that a licensee has illegally discriminated while engaged in any activity for which a license is required under this Act, the Department, following the provision of notice to the licensee and a hearing conducted in accordance with Section 20-43 and upon the recommendation of the Board as to the extent of the suspension or revocation, shall suspend or revoke the license of that licensee in a timely manner, unless the adjudication is in the appeal process. The finding or judgment of the civil or criminal proceeding is a matter of record and the merits of the finding or judgment shall not be challenged in a request for a hearing by the licensee.\n(b) When there has been an order in an administrative proceeding finding that a licensee has illegally discriminated while engaged in any activity for which a license is required under this Act, the Department, following the provision of notice to the licensee and a hearing conducted in accordance with Section 20-43 and upon recommendation of the Board as to the nature and extent of the discipline, shall take one or more of the disciplinary actions provided for in this Act in a timely manner, unless the administrative order is in the appeal process.
