{"data":{"id":"us-il/225-ilcs-51-35","jurisdiction":"us-il","citation":"225 ILCS 51/35","heading":"Qualifications for licensure.","body":"(Section scheduled to be repealed on January 1, 2028)\n(a) An entity is qualified to receive a license as a home medical equipment and services provider if the entity meets each of the following requirements:\n(1) complies with all applicable federal and State licensure and regulatory requirements;\n(2) maintains a physical facility and medical equipment inventory. There shall only be one license permitted at each address;\n(3) establishes proof of commercial general liability insurance, including but not limited to coverage for products liability and professional liability;\n(4) establishes and provides records of annual continuing education for personnel engaged in the delivery, maintenance, repair, cleaning, inventory control, and financial management of home medical equipment and services;\n(5) maintains records on all patients to whom it provides home medical equipment and services;\n(6) establishes equipment management and personnel policies;\n(7) makes life-sustaining home medical equipment and services available 24 hours per day and 7 days per week;\n(8) complies with any additional qualifications for licensure as determined by rule of the Department.\n(b) The Department may request a personal interview of an applicant before the Board to further evaluate the entity's qualifications for licensure.","path":["CHAPTER 225 PROFESSIONS, OCCUPATIONS, AND BUSINESS OPERATIONS","Home Medical Equipment and Services Provider License Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=1306\u0026ChapterID=24\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:31Z","sha256":"2fcdb548580d4b088c18bd7ea6f36930e83b5932a1366a4f210eb83826f372db","source_id":"us-il","stale":false,"prev":"us-il/225-ilcs-51-30","next":"us-il/225-ilcs-51-40"},"notice":"GroundRules: Original legal text.
