{"data":{"id":"us-il/305-ilcs-5-6-2.1","jurisdiction":"us-il","citation":"305 ILCS 5/6-2.1","heading":"Assets of homeless persons.","body":"(a) For the purpose of assisting homeless persons in securing housing, all assistance units that include a homeless person shall have an asset disregard no less than that applicable to recipients of benefits under Article 4 of this Code. For purposes of this Section, \"homeless\" or \"homeless person\" means either of the following:\n(1) An individual who lacks a fixed, regular, and adequate nighttime residence; or\n(2) An individual who has a primary nighttime residence that is any of the following:\n(A) A supervised publicly or privately operated shelter designed to provide temporary living accommodations (including welfare hotels, congregate shelters, and transitional housing for the mentally ill).\n(B) An institution that provides a temporary residence for individuals intended to be institutionalized.\n(C) A public or private place not designed for, or ordinarily used as, a regular sleeping accommodation for human beings.\n(b) While the Illinois Department shall consider other indicia of homelessness in determining whether a person is homeless, a letter from a shelter provider stating that a person is homeless or residing in its shelter shall create a rebuttable presumption that the person is homeless.","path":["CHAPTER 305 PUBLIC AID","Illinois Public Aid Code."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=1413\u0026ChapterID=28\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:32Z","sha256":"3bfadbf0345e5e5d45423d88d0723664064a8cda14a6529a97746d5a55ba2721","source_id":"us-il","stale":false,"prev":"us-il/305-ilcs-5-6-2","next":"us-il/305-ilcs-5-6-3"},"notice":"GroundRules: Original legal text.
