{"data":{"id":"us-il/305-ilcs-90-2-10","jurisdiction":"us-il","citation":"305 ILCS 90/2-10","heading":"Definition.","body":"As used in this Act, \"certified family health aide\" means a person who:\n(1) is 18 years of age or older;\n(2) has the following relationship with the family member receiving or who is eligible to receive the services enumerated in this Section:\n(i) spouse;\n(ii) sibling or stepsibling;\n(iii) parent, stepparent, or adoptive parent;\n(iv) grandparent;\n(v) mother-in-law or father-in-law;\n(vi) brother-in-law or sister-in-law;\n(vii) legal guardian; or\n(viii) caregiver designated by the legally responsible caregiver as documented in the Medical Plan of Care;\n(3) is a legally responsible caregiver, or has been designated by a legally responsible caregiver, for a person who receives or is eligible to receive:\n(i) in-home shift nursing services under the Early and Periodic Screening, Diagnostic and Treatment requirement of Medicaid under 42 U.S.C. 1396d(r); or\n(ii) in-home shift nursing through the home and community-based services waiver program authorized under Section 1915(c) of the Social Security Act for persons who are medically fragile and technology dependent; and\n(4) is certified pursuant to this Section to perform or to assist in performance of services to and for a person receiving or eligible to receive: (A) in-home shift nursing services under the Early and Periodic Screening, Diagnostic and Treatment requirement of Medicaid under 42 U.S.C. 1396d(r); or (B) in-home shift nursing services through the home and community-based services waiver program authorized under Section 1915(c) of the Social Security Act for a designated person or designated persons who are medically fragile and technology dependent and eligible to receive the services laid out in this Section, including:\n(i) the same tasks as a certified nursing assistant;\n(ii) medication administration;\n(iii) enteral care and therapy; and\n(iv) other needed services to support the individual as provided by rule.","path":["CHAPTER 305 PUBLIC AID","Certified Family Health Aide Program for Children and Adults Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4601\u0026ChapterID=28\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:32Z","sha256":"a42f2d5572c50ce26da9d71ee079e9004ee03b3079aa19ded1ea0ace47c8245c","source_id":"us-il","stale":false,"prev":"us-il/305-ilcs-90-2-5","next":"us-il/305-ilcs-90-2-15"},"notice":"GroundRules: Original legal text.
