Notwithstanding Section 9-148, if a member was not married at the time of retirement but married after retirement, that member's widow shall be entitled to a widow's annuity if (1) the widow was married to the member for at least the last year prior to the member's death; (2) the widow is otherwise eligible for a widow's annuity; and (3) the widow repays to the Fund (i) an amount equal to the amount of any refund paid to the member at the time of retirement pursuant to Section 9-165 plus (ii) interest thereon from the date of the refund until the time of repayment at the rate of 6% per year.","path":["CHAPTER 40 PENSIONS","Illinois Pension Code."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=638\u0026ChapterID=9\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:20Z","sha256":"b019fb116049d859fcf09730e09e64be37ee278851bb8e04340b743d8bd0ce72","source_id":"us-il","stale":false,"prev":"us-il/40-ilcs-5-9-148","next":"us-il/40-ilcs-5-9-149"},"notice":"GroundRules: Original legal text.
