{"data":{"id":"us-il/5-ilcs-850-10","jurisdiction":"us-il","citation":"5 ILCS 850/10","heading":"Background checks on speakers prohibited.","body":"(a) A law enforcement agency or an officer employed by a law enforcement agency may not knowingly and intentionally conduct a background check of a person for the sole reason of that person speaking at an open meeting of a public body, including police disciplinary boards.\n(b) Subsection (a) does not apply: whenever an agency or officer develops a reasonable suspicion of criminal conduct or a reasonable suspicion of a threat to security for the premises in which the meeting is to occur or for the protection of public officials and other persons attending the meeting; and whenever the person speaking at an open meeting of the public body is also under consideration for appointment to a government position by that public body.\n(c) This Act creates no claims for damages or other relief for violations of this Act.","path":["CHAPTER 5 GENERAL PROVISIONS","Empowering Public Participation Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4190\u0026ChapterID=2\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:12Z","sha256":"fb3c7492f31365dba85ca00a48c20ec2e1da522719dca88ef7be61ccdd78520d","source_id":"us-il","stale":false,"prev":"us-il/5-ilcs-850-5","next":"us-il/5-ilcs-850-15"},"notice":"GroundRules: Original legal text.
