Any 25 or more owners of land lying within the limits of the territory proposed to be organized into a district who own at least 10% of the land, by area, within such proposed district may file a petition with the Department asking that a soil and water conservation district be organized in the territory described in the petition. Such petition shall set forth:\n(1) The proposed name of said district;\n(2) That there is a need, in the interest of the public health, safety, and welfare, for a soil and water conservation district to function in the territory described in the petition;\n(3) A reasonably accurate description of the territory proposed to be organized as a district.\n(4) A request that the Department duly define the boundaries for such district; that a referendum be held within the territory so defined on the question of the creation of a soil and water conservation district in such territory; and that the Department determine that such a district be created.\nWhere more than one petition is filed covering the same or parts of the same territory, the Department may consolidate all or any of such petitions.","path":["CHAPTER 70 SPECIAL DISTRICTS","Soil and Water Conservation Districts Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=857\u0026ChapterID=15\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:23Z","sha256":"630d1952ea5a4d7d06d6bf3c6586dd6c63b5524b33bc46ddc50c2bcdce8cb16c","source_id":"us-il","stale":false,"prev":"us-il/70-ilcs-405-7","next":"us-il/70-ilcs-405-9"},"notice":"GroundRules: Original legal text.
