{"data":{"id":"us-il/725-ilcs-5-107-12","jurisdiction":"us-il","citation":"725 ILCS 5/107-12","heading":"Notice to appear.","body":"(a) Whenever a peace officer is authorized to arrest a person without a warrant he may instead issue to such person a notice to appear.\n(b) The notice shall:\n(1) Be in writing;\n(2) State the name of the person and his address, if known;\n(3) Set forth the nature of the offense;\n(4) Be signed by the officer issuing the notice; and\n(5) Request the person to appear before a court at a certain time and place.\n(c) Upon failure of the person to appear a summons or warrant of arrest may issue.\n(d) In any case in which a person is arrested for a Class C misdemeanor or a petty offense and remanded to the sheriff other than pursuant to a court order, the sheriff may issue such person a notice to appear.","path":["CHAPTER 725 CRIMINAL PROCEDURE","Code of Criminal Procedure of 1963."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=1966\u0026ChapterID=54\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:42Z","sha256":"7134959815a256765d2315c69107d63cec5d31d7255ecdadec6ae3d7041564d5","source_id":"us-il","stale":false,"prev":"us-il/725-ilcs-5-107-11","next":"us-il/725-ilcs-5-107-13"},"notice":"GroundRules: Original legal text.
