{"data":{"id":"us-il/740-ilcs-110-9.5","jurisdiction":"us-il","citation":"740 ILCS 110/9.5","heading":"Use and disclosure of information to an HIE.","body":"(a) An HIE, person, therapist, facility, agency, interdisciplinary team, integrated health system, business associate, or covered entity may, without a recipient's consent, use or disclose information from a recipient's record in connection with an HIE, an HIE, or the business associate of either. An HIE and its business associate may, without a recipient's consent, use or disclose and re-disclose such information for HIE purposes or for such other purposes as are specifically allowed under this Act.\n(b) As used in this Section:\n(1) \"facility\" means a developmental disability facility as defined in Section 1-107 of the Mental Health and Developmental Disabilities Code or a mental health facility as defined in Section 1-114 of the Mental Health and Developmental Disabilities Code; and\n(2) the terms \"disclosure\" and \"use\" have the meanings ascribed to them under HIPAA, as specified in 45 CFR 160.103.","path":["CHAPTER 740 CIVIL LIABILITIES","Mental Health and Developmental Disabilities Confidentiality Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=2043\u0026ChapterID=57\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:43Z","sha256":"21f9845dc45422616a3fd340509bc4e92a1982dc88325537b812f0d6031c5c38","source_id":"us-il","stale":false,"prev":"us-il/740-ilcs-110-9.4","next":"us-il/740-ilcs-110-9.6"},"notice":"GroundRules: Original legal text.
