{"data":{"id":"us-il/740-ilcs-110-9.9","jurisdiction":"us-il","citation":"740 ILCS 110/9.9","heading":"Record locator service.","body":"(a) An HIE, person, therapist, facility, agency, interdisciplinary team, integrated health system, business associate, covered entity, or entity facilitating the establishment or operation of an HIE may, without a recipient's consent, disclose the existence of a recipient's record to a record locator service, master patient index, or other directory or services necessary to support and enable the establishment and operation of an HIE.\n(b) As used in this Section:\n(1) the term \"disclosure\" has the meaning ascribed to it under HIPAA, as specified in 45 CFR 160.103; and\n(2) \"facility\" means a developmental disability facility as defined in Section 1-107 of the Mental Health and Developmental Disabilities Code or a mental health facility as defined in Section 1-114 of the Mental Health and Developmental Disabilities Code.","path":["CHAPTER 740 CIVIL LIABILITIES","Mental Health and Developmental Disabilities Confidentiality Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=2043\u0026ChapterID=57\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:43Z","sha256":"a4989f5d3e4a222a2e878db2dae66b50e5cbc84755f3ec7692ec91f239dcca58","source_id":"us-il","stale":false,"prev":"us-il/740-ilcs-110-9.8","next":"us-il/740-ilcs-110-9.10"},"notice":"GroundRules: Original legal text.
