{"data":{"id":"us-il/740-ilcs-190-10","jurisdiction":"us-il","citation":"740 ILCS 190/10","heading":"Civil action.","body":"(a) Except as otherwise provided in Section 15, if a depicted individual is identifiable to a reasonable person and suffers harm from the intentional dissemination or threatened dissemination by a person over the age of 18 of a private or intentionally digitally altered sexual image without the depicted individual's consent, the depicted individual has a cause of action against the person if the person knew or recklessly disregarded the possibility that:\n(1) the depicted individual did not consent to the dissemination;\n(2) the image was a private or intentionally digitally altered sexual image; and\n(3) the depicted individual was identifiable.\n(b) The following conduct by a depicted individual does not establish by itself that the individual consented to the nonconsensual dissemination of a private sexual image that is the subject of an action under this Act or that the individual lacked a reasonable expectation of privacy:\n(1) consent to creation of the image; or\n(2) previous consensual disclosure of the image.\n(c) In the case of digitally altered sexual images, disclosing that the images were digitally altered shall not be a defense to liability.","path":["CHAPTER 740 CIVIL LIABILITIES","Civil Remedies for Nonconsensual Dissemination of Private Sexual Images Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=4035\u0026ChapterID=57\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:43Z","sha256":"e9ece100de24f73fbcba1327744e3efb28cece5ec14f2f44a8ee0c75382b8035","source_id":"us-il","stale":false,"prev":"us-il/740-ilcs-190-5","next":"us-il/740-ilcs-190-15"},"notice":"GroundRules: Original legal text.
