{"data":{"id":"us-il/750-ilcs-46-302","jurisdiction":"us-il","citation":"750 ILCS 46/302","heading":"Execution of voluntary acknowledgment.","body":"(a) A voluntary acknowledgment described in Section 301 of this Act must:\n(1) be in a record;\n(2) be signed, or otherwise authenticated, under penalty of perjury by the woman or person who gave birth to the child and by the person seeking to establish parentage;\n(3) state that the child whose parentage is being acknowledged:\n(A) does not have a presumed parent, or has a presumed parent whose full name is stated; and\n(B) does not have another acknowledged or adjudicated parent;\n(4) be witnessed; and\n(5) state that the signatories understand that the voluntary acknowledgment is the equivalent of a judicial adjudication of parentage of the child and that: (i) a challenge by a signatory to the voluntary acknowledgment may be permitted only upon a showing of fraud, duress, or material mistake of fact; and (ii) a challenge to the voluntary acknowledgment is barred after 2 years unless that period is tolled pursuant to the law.\n(b) An acknowledgment is void if it:\n(1) states that another person is a presumed parent, unless a denial signed or otherwise authenticated by the presumed parent is filed with the Department of Healthcare and Family Services, as provided by law;\n(2) states that another person is an acknowledged or adjudicated parent; or\n(3) falsely denies the existence of a presumed, acknowledged, or adjudicated parent of the child.\n(c) A presumed parent may sign or otherwise authenticate a voluntary acknowledgment.","path":["CHAPTER 750 FAMILIES","Illinois Parentage Act of 2015."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=3638\u0026ChapterID=59\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:44Z","sha256":"86ed30fd4d1932079ded474083d0e50ad041eca10e2394b39b7ff4171eed642d","source_id":"us-il","stale":false,"prev":"us-il/750-ilcs-46-301","next":"us-il/750-ilcs-46-303"},"notice":"GroundRules: Original legal text.
