{"data":{"id":"us-il/755-ilcs-27-55","jurisdiction":"us-il","citation":"755 ILCS 27/55","heading":"Revocation by recorded instrument authorized; revocation by act or unrecorded instrument, not authorized.","body":"(a) An instrument is effective to revoke a recorded transfer on death instrument, or any part of it, only if:\n(1) it is:\n(A) another transfer on death instrument that revokes the instrument or part of the instrument expressly or by inconsistency; or\n(B) an instrument of revocation that expressly revokes the instrument or part of the instrument; and\n(2) it is:\n(A) executed, witnessed, and acknowledged in the same manner as is required by Section 45 on a date that is after the date of the acknowledgment of the instrument being revoked; and\n(B) recorded before the owner's death in the public records in the office of the recorder of the county or counties where the prior transfer on death instrument is recorded.\n(b) A transfer on death instrument executed and recorded in accordance with this Act may not be revoked by a revocatory act on the instrument, by an unrecorded instrument, or by a provision in a will.","path":["CHAPTER 755 ESTATES","Real Property Transfer on Death Instrument Act."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=3382\u0026ChapterID=60\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:44Z","sha256":"e3cd56314eed81a3f98e08a04ebc98eb10215b0dae99c30b638de1a9238a1723","source_id":"us-il","stale":false,"prev":"us-il/755-ilcs-27-50","next":"us-il/755-ilcs-27-60"},"notice":"GroundRules: Original legal text.
