{"data":{"id":"us-il/755-ilcs-70-8","jurisdiction":"us-il","citation":"755 ILCS 70/8","heading":"Disclosure of other digital assets of deceased user.","body":"Unless the user prohibited disclosure of digital assets or the court directs otherwise, a custodian shall disclose to the personal representative of the estate of a deceased user a catalogue of electronic communications sent or received by the user and digital assets, other than the content of electronic communications, of the user, if the representative gives the custodian:\n(1) a written request for disclosure in physical or electronic form;\n(2) a certified copy of the death certificate of the user;\n(3) a certified copy of the letter of appointment of the representative or a court order; and\n(4) if requested by the custodian:\n(A) a number, username, address, or other unique subscriber or account identifier assigned by the custodian to identify the user's account;\n(B) evidence linking the account to the user;\n(C) an affidavit stating that disclosure of the user's digital assets is reasonably necessary for administration of the estate; or\n(D) a finding by the court that:\n(i) the user had a specific account with the custodian, identifiable by the information specified in subparagraph (A); or\n(ii) disclosure of the user's digital assets is permitted under this Act and reasonably necessary for administration of the estate.","path":["CHAPTER 755 ESTATES","Revised Uniform Fiduciary Access to Digital Assets Act (2015)."],"source_url":"https://www.ilga.gov/legislation/ILCS/details?ActID=3728\u0026ChapterID=60\u0026ChapAct=FullText\u0026Print=True","current_through":"at least Public Act 104-790","vintage":"","retrieved_at":"2026-09-15T04:46:44Z","sha256":"ca2483a1d75096619c3f421103e7031bd4179d86e8fd18b861ddd351daa86722","source_id":"us-il","stale":false,"prev":"us-il/755-ilcs-70-7","next":"us-il/755-ilcs-70-9"},"notice":"GroundRules: Original legal text.
